2. Purpose

These Terms of Service (hereinafter, "Terms") govern access to and use of the Argentica platform, a SaaS (Software as a Service) artificial intelligence service that enables users to connect external tools, automate tasks and obtain intelligent answers through language models (LLM).

Use of the Platform implies full acceptance of these Terms. If you do not agree with any of the conditions, you must refrain from using the service.

3. Registration and User Account

  • Users must be at least 16 years old to create an account.
  • Users are responsible for maintaining the confidentiality of their access credentials.
  • Each account is personal and non-transferable, except for accounts managed by a Reseller under a commercial agreement.
  • Users must provide truthful information and keep it up to date.

4. Description of the Service

Argentica provides:

  • AI Chat: Conversational interface with third-party artificial intelligence models.
  • MCP Integrations: Connection with external services (email, calendar, CRM, databases, etc.) via Model Context Protocol.
  • Automated Tasks: Scheduling and automated execution of actions on connected tools.
  • Knowledge Base: Semantic indexing of user documents for intelligent search.
  • Storage: File management with encryption and secure storage.
  • White Label: Brand customization for resellers and agencies.

5. Processing via Artificial Intelligence

5.1 LLM Providers

5.2 Transparency

  • Responses are generated by AI and may contain errors or inaccuracies.
  • Users should not rely on responses as the sole source for critical decisions (medical, legal, financial).
  • Data sent to LLM providers is processed in accordance with their respective privacy policies. Argentica does not store responses on third-party servers beyond request processing.

5.3 Granular Consent

Users can control what data is shared with AI models through the consent panel in their profile:

  • Memory and chat history
  • Profile data (imprint)
  • Consent for processing by external LLMs
  • Usage analytics

6. Pricing and Billing

Argentica operates on a prepaid (pay-as-you-go) model. Users purchase balance that is consumed based on actual usage of AI models, integrations and storage.

Prices are displayed in US dollars (USD). Argentica reserves the right to modify rates with 30 days' prior notice.

6.1 Model Arbitrage

Argentica automatically routes each query to the optimal AI model based on its complexity, optimizing the cost-quality ratio for the user. The cost of each operation depends on the model used, the volume of data processed and the tools invoked. Consumption details are available in real time in the "My Usage" section of the application.

6.2 Balance and Top-ups

Balance does not expire as long as the account remains active. Top-ups are processed through Stripe. Balance is non-refundable except as provided by applicable law.

7. Acceptable Use

Users agree to:

  • Not use the Platform for illegal, fraudulent or harmful activities.
  • Not attempt to access other users' data or internal systems.
  • Not perform reverse engineering, scraping or attacks against the Platform.
  • Not generate content that violates third-party rights, is defamatory, or incites hatred or violence.
  • Not use the Platform to generate spam, phishing or malware.
  • Not intentionally overload system resources.

Breach of these conditions may result in immediate suspension or cancellation of the account without prior notice.

8. Intellectual Property

  • The Platform, its code, design and infrastructure are the property of Argentica.
  • Data and files uploaded by users remain the property of the user.
  • Users grant Argentica a limited license to process their data exclusively for the purpose of providing the service.

9. Limitation of Liability

  • Argentica provides the service "as is", without guarantees of uninterrupted availability.
  • Argentica is not responsible for responses generated by AI models nor for actions executed on third-party tools at the user's request.
  • Argentica's maximum liability shall be limited to the amount paid by the user in the last 12 months.
  • Argentica shall not be liable for indirect damages, lost profits or data loss caused by third-party provider failures.

10. Data Protection

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

11. Resellers and White Label

  • Resellers may offer the Platform under their own brand.
  • The relationship between the reseller and their end clients is the responsibility of the reseller.
  • Argentica acts as data processor with respect to reseller clients.

12. Modification of Terms

Argentica reserves the right to modify these Terms. Changes will be notified to users with a minimum of 30 days' prior notice. Continued use of the service after notification implies acceptance of the new Terms.

13. Termination and Cancellation

  • Users may cancel their account at any time from their profile.
  • After cancellation, user data will be deleted in accordance with the Privacy Policy (365-day retention period, unless immediate deletion is requested).
  • Argentica may terminate the agreement unilaterally in case of breach of these Terms.

14. Governing Law and Jurisdiction

  • These Terms are governed by Spanish law.
  • For the resolution of any dispute, the parties submit to the Courts of Bilbao (Bizkaia), with express waiver of any other jurisdiction that may apply.
